Prohibition on the
Keeping of Poultry, Livestock, or Wild Animals
Be it enacted by the
Board of Trustees of the Village of Otisville that this local law amends the
Village of Otisville’s Comprehensive Zoning Law of 2011 as follows:
SECTION
I: Intent:
The Village of Otisville’s Comprehensive Zoning Law of 2011 makes no
allowance for the keeping of poultry, livestock, or wild animals within the
Village. This local law is intended to further define and clarify that prohibition.
SETION II:
Chapter 2, Article 5, Section 5.3, of the Village of Otisville’s Comprehensive
Zoning Law of 2011, (Prohibited Uses in All Districts), shall be amended as
follows:
Add new section 5.3.6: The keeping
of poultry, livestock, or wild animals for any purpose.
SECTION III: Appendix
A of the Village of Otisville’s Comprehensive Zoning Law of 2011 shall be amended
by adding the following definitions:
Livestock – animals such as, but not limited to, cattle,
sheep, pigs, goats, horses, donkeys, mules, buffalo, oxen, llamas, alpaca, and
camels
Poultry - birds such as, but not limited to, chickens,
ducks, turkeys, geese, pigeons, guinea fowl and squabs
Wild Animals – animals such as, but not limited to,
squirrels, chipmunks, opossum, woodchucks, and skunks
SECTION IV: Saving Clause:
In the event that
any provision of this law is declared unconstitutional or invalid, or the
application thereof to any person or circumstances is held invalid, the
applicability of such provision to other persons and circumstances and the
constitutionality or validity of every other provision of the law shall not be
affected thereby.
SECTION V: Effective Date:
This local law was adopted by the Village of Otisville Board
of Trustees by resolution on July 7, 2022 and shall take effect immediately
upon its filing with the Secretary of State of the State of New York.
